Visa Compliance Services
Travelling to and staying in South Africa, foreign nationals have a lot to prepare for. Immigration Law provides guidance on the important immigration documentation and procedures travellers need to be aware of. This includes assisting with visa processing at South African Embassies or Visa facilitation Service (VFS), security clearance and immigration regulations and obligations thereof.
Follow-up with Visa Processing
The processing time for applications of South African visa depends on the type of visas as well as the workload at the Department of Home Affairs (DHA). Hence applications are examined on case by case basis. Immigration Law assists with the facilitation and expediting of pending applications as well as consultations with the Department where necessary at any stage of the visa application until finalization of the process
Change of Visa Conditions
All foreign citizens are required to have a valid passport and permanent/temporary residence visa such to live, work or study in South Africa and other. In cases where a foreign citizen wishes to change the conditions of their visa (such as name of institutions they are attached to) they are required to lodge an application by the Department of Home Affairs. Here Immigration Law Associates provides assistance in this regard.
Waiver Application Processing
The South African Immigration Law requires foreign citizens to meet certain requirements in order to submit an application for a visa. However, individuals may be allowed to bypass or may be exempted to fulfil certain requirements. Hence they need to submit such request to the Department. Here at Immigration Law Associates we provide assistance in this regard for the DHA to dispense with some of the requirements in Visa applications where good cause is shown.
Letter of Good Cause Processing
All Temporary South Africa visas are issued for a specific period of time. However, in some extenuating circumstances a foreign citizen may overstay or violate the conditions of their visa. This may affect their future visa applications to South Africa. In that case a foreign citizen is required to submit in writing and explaining their circumstance. Immigration Law Associates provides assistance with the preparation and submission of good cause applications to the DHA for violation of Visa conditions
Prohibited and Undesirable Persons
According to South Africa’s immigration law, a foreigner may be prohibited from entering or obtaining a South Africa visa having violated immigration laws. Typically, a foreign citizen may obtain fraudulent visas (knowing or unknowingly) or overstaying their visa. In such cases the immigrant may not be allowed to enter South Africa for a period of time or indefinitely. Here at Immigration Law, assistance is provided to request and appeal with the DHA for such status to be overturned or removed.
